Terms of Service

1. Acceptance of Terms

By creating an account or using Pulse by A.I.M ("Pulse," "the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These Terms constitute a binding legal agreement between you and Pulse by A.I.M LLC.

2. Description of Service

Pulse is a contact management and SMS outreach platform that allows users to manage leads, send text messages, automate follow-ups using AI, and track deals. The platform is intended for lawful business use by adults 18 years of age or older.

3. TCPA Compliance — Your Responsibility

By using Pulse to send SMS messages, you represent and warrant that:

• You have obtained prior express written consent from all recipients before sending marketing texts
• You will honor all opt-out requests immediately and permanently
• You will include "Reply STOP to opt out" language in all marketing messages (Pulse templates include this by default)
• You will not send messages to numbers on the National Do Not Call Registry without proper consent
• You will not send messages between 9:00 PM and 8:00 AM in the recipient's local time zone
• You will not use the platform for spam, phishing, harassment, or any unlawful purpose
• Your messaging complies with all carrier guidelines and the CTIA Messaging Principles

Pulse by A.I.M LLC is not liable for TCPA violations, fines, lawsuits, or regulatory actions arising from your use of the messaging features. Violations may result in immediate account termination.

4. Acceptable Use Policy

You agree NOT to use Pulse to:

• Send unsolicited bulk messages (spam)
• Harass, threaten, or deceive any person
• Impersonate any person or entity
• Send messages containing illegal content, hate speech, or adult content
• Violate any applicable law or regulation
• Attempt to reverse-engineer, scrape, or exploit the platform
• Resell or sublicense access to the platform without written permission
• Share your login credentials, password, or active session with any other person, or allow more than one individual to use a single Pulse subscription
• Use the platform for any purpose other than legitimate business outreach

We reserve the right to suspend or terminate accounts that violate this policy without refund.

5. Subscriptions & Billing

Pulse is offered as a subscription service. By subscribing, you authorize Pulse by A.I.M LLC to charge your payment method on a recurring basis (monthly or annually depending on your plan).

• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel anytime from your account settings — cancellation takes effect at the end of the current billing period
• We do not offer prorated refunds for partial billing periods unless required by law
• Prices are subject to change with 30 days advance notice to active subscribers
• All payments are processed by Stripe and subject to Stripe's terms

One active session per account. Each Pulse subscription is licensed to a single user and permits one active signed-in session at a time. When a new sign-in is detected on your account, any other browser currently signed in will be automatically signed out. Repeated credential-sharing attempts may result in account suspension without refund.

6. Your Data

You retain full ownership of all lead data, contact data, and messages you create within the platform. By using Pulse, you grant Pulse by A.I.M LLC a limited license to store and process this data solely to provide the Service to you. We do not sell, share, or use your data for any purpose other than operating the platform.

7. AI Features Disclaimer

AI-generated reply suggestions, conversation coaching, and auto-reply features are provided as tools to assist you — they are not legal, financial, or professional advice. You are responsible for reviewing all AI-generated content before sending. Pulse by A.I.M LLC is not liable for any outcomes resulting from AI-generated messages sent on your behalf.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PULSE BY A.I.M LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• TCPA violations, fines, or legal actions resulting from your messaging activities
• Loss of leads, deals, or business opportunities
• Service outages, data loss, or delivery failures
• Any actions taken by AI features on your behalf

Our total liability to you for any claim shall not exceed the amount you paid us in the three (3) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Pulse by A.I.M LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights, including TCPA violations.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications at any time. We are not liable for any downtime, delivery failures, or service interruptions.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, illegal activity, or abuse of the platform, without prior notice and without refund. You may terminate your account at any time by cancelling your subscription and contacting support to delete your data.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the American Arbitration Association rules, conducted in North Carolina. Class action lawsuits are waived to the extent permitted by law.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or platform notice at least 14 days before taking effect. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
